Examples of Successful Appeals

  • In re Clifford M., 6 Neb. App. 754 (1998) (first Nebraska appellate court case that specifically addressed whether a parent’s parental rights could be terminated solely for refusing to waive the fundamental constitutional right against self-incrimination; mother prevailed on her argument that juvenile court committed error by requiring her to admit sexual abuse prior to participating in family therapy when she could have been criminally prosecuted if she admitted to having sexually abused children)
  • Jack v. Clinton, 259 Neb. 198 (2000) (mother asked Nebraska Supreme Court to review a decision by Nebraska Court of Appeals that went against mother’s legal position; mother prevailed on her argument that the trial court’s decision to allow her to permanently change children’s residence to a state other than Nebraska had been correct)
  • Zoucha v. Henn, 258 Neb. 611 (2000) (mother of a child born out-of-wedlock decided not to establish paternity so she could defeat a request for grandparent visitation by the parents of the child’s biological father; she succeeded in defeating that grandparent visitation request)
  • Wild v. Wild, 13 Neb. App. 495 (2005) (father successfully defeated mother’s attempt to permanently change child’s residence to a state other than Nebraska)
  • Wild v. Wild (Wild II), 15 Neb. App. 717 (2007) (father again successfully defeated mother’s 3rd attempt to permanently change child’s residence to a state other than Nebraska)
  • Thompson v. Thompson, 18 Neb. App. 363 (2010) (where there was a marriage of long duration, wife successfully challenged trial court’s decision to divide wife’s 401(k) plan money equally between husband and wife)
